TxANA Stands Against Anticompetitive Rules Approved by the Texas Medical Board

Austin, TX – The Texas Association of Nurse Anesthetists (TxANA) would like to let members know that during the Texas Medical Board (TMB) hearing on December 13th, the TMB approved rules that restrict Certified Registered Nurse Anesthetist (CRNA) practice.

​TxANA urged the TMB to submit these rules to the Texas Regulatory Compliance Division for review, as required by Texas law, to ensure fair competition and compliance. This request, as well as our testimony during the hearing, was disregarded. This situation highlights the challenges that can arise when one profession has regulatory authority over another. We remain committed to advocating for legislative changes that eliminate unnecessary delegation requirements such as those recently imposed by the Texas Medical Board, by enabling CRNAs to practice to the full extent of their education and training through the granting of full practice authority.
​Here are a summary of the changes:
  • §164.3: Requires physicians to disclose supervision or delegation to non-physicians in advertising.
  • §169.2: Mandates detailed written protocols, exceeding state law requirements.
  • §169.27: Demands inclusion of “appropriate care” in written orders, contrary to state law.
  • §173.2: Expands supervision requirements for outpatient anesthesia services.
  • §177.2: Obligates physicians to post complaint notifications at locations where CRNAs provide care without a physician present.
