TxANA Stands Against Anticompetitive Rules Approved by the Texas Medical Board

Austin, TX – The Texas Association of Nurse Anesthetists (TxANA) would like to let members know that during the Texas Medical Board (TMB) hearing on December 13th, the TMB approved rules that restrict Certified Registered Nurse Anesthetist (CRNA) practice.

TxANA urged the TMB to submit these rules to the Texas Regulatory Compliance Division for review, as required by Texas law, to ensure fair competition and compliance. This request, as well as our testimony during the hearing, was disregarded. This situation highlights the challenges that can arise when one profession has regulatory authority over another. We remain committed to advocating for legislative changes that eliminate unnecessary delegation requirements such as those recently imposed by the Texas Medical Board, by enabling CRNAs to practice to the full extent of their education and training through the granting of full practice authority.
Here are a summary of the changes:
  • §164.3: Requires physicians to disclose supervision or delegation to non-physicians in advertising.
  • §169.2: Mandates detailed written protocols, exceeding state law requirements.
  • §169.27: Demands inclusion of “appropriate care” in written orders, contrary to state law.
  • §173.2: Expands supervision requirements for outpatient anesthesia services.
  • §177.2: Obligates physicians to post complaint notifications at locations where CRNAs provide care without a physician present.

Detailed updates here.

This is all part of Sharif Zaafran’s (TMB President and anesthesiologist for USAP) plan to limit CRNAs practice in state of Texas. He has been at this for years and will not stop, so we need to get out in front of this and stay out in front of his next moves. I worked with him at USAP and I know he will not stop so we better not take him lightly or I’ll practice will be reduced to the AA role which is his ultimate goal.

I started practicing in 1981 and became active in TxANA shortly after. We have been fighting this battle for as long as I can remember. Retired in 2011 but remain interested in what our association is doing. Stand strong and never give up on our goal for independent CRNA practice. Thousands of CRNAs across Texas are counting on you.

I have been practicing since 1990 and have practiced independently in a number of setting such as rural and metropolitan areas. Over the past 7 years have been practicing chronic pain after completing an externship. I have been refused payment for my services in two institutions and there is a target on your back when you are a CRNA practicing chronic pain. Since we are trained to all of the interventional pain management, we are viewed as a direct threat to physician pain practitioners. I have known CRNA's that have opened up their own clinics and have obtained collaborator and get reported to the Nursing board for practicing out of their scope when in fact they were not. Also the TMA malpractice insurance will charge collaborators outrageous insurance premiums for collaborating. I am so sick and tired of their undermining ways to obstruct our practice. Please help!!

Donate to the tx ANA pac to protect your practice
I just did for me and two people that work with me. It may not make a difference today but it will in a year or two. So this is a great way to protect your paycheck and independence.
